4. Participation in Quests and Treasure Hunts

Participation in Off Road Treasure Quest activities, including treasure hunts and quests, is voluntary and at your own risk. By participating, you acknowledge the following:

• Off Road driving and outdoor activities involve inherent risks, including injury, property damage, and other hazards.
• You are responsible for your own safety and the safety of others in your party.
• You agree to follow all local laws, regulations, and safety guidelines, including those related to Off Road vehicle use.
• You must not exceed your skill level or take unnecessary risks.

Off Road Treasure Quest does not guarantee the availability, accessibility, or safety of any quest location.

5. Payment and Fees

Participation in quests may require payment of fees. These fees are non-refundable, except as required by law. We may modify the pricing of the Service at any time.

6. Treasure Hunts and Prizes

Qualifying users who accumulate sufficient points may receive a treasure map, which contains clues to locate a real-life treasure. The following rules apply to treasure hunts:

• Only the qualified user who receives the treasure map may redeem the prize.
• Prizes are subject to availability and must be redeemed according to the instructions provided.
• Off Road Treasure Quest is not responsible for lost, stolen, or damaged treasure maps or prizes.

7. Assumption of Risk

By participating in any Off Road Treasure Quest activities, you acknowledge and assume all risks associated with Off Road driving, outdoor exploration, and treasure hunts, including but not limited to physical injury, environmental hazards, and equipment failure. You agree to release and hold harmless Off Road Treasure Quest from any claims, damages, or liabilities arising from your participation in the Service.

8. User Conduct

You agree to:

• Use the Service responsibly and respect the environment.
• Follow “Leave No Trace” principles when engaging in outdoor activities.
• Not engage in any behavior that may harm other users, wildlife, or the environment.

9. Modifications to the Service

Off Road Treasure Quest reserves the right to modify, suspend, or discontinue any part of the Service at any time without notice. We may also update these Terms periodically, and your continued use of the Service after any changes constitutes your acceptance of the new Terms.

10. Termination

We may terminate or suspend your account or access to the Service at any time, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Service will immediately cease.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available,” without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

12. Limitation of Liability

To the maximum extent permitted by law, Off Road Treasure Quest and its affiliates, officers, employees, agents, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

13. Indemnification

You agree to indemnify and hold Off Road Treasure Quest, its affiliates, officers, and employees harmless from any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of your use of the Service or violation of these Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state of Texas, without regard to its conflict of law principles. Any disputes arising from these Terms or the use of the Service shall be resolved in the courts located in Texas.
